Forensic Business Pathology®
At the Taormina Group, we believe that determining standard of care should be based upon a solid science, not on an expert’s opinion. FBP is a set of tools that when skillfully implemented, has a profound impact on case outcomes.
Forensic Business Pathology® is a comprehensive approach to investigation that looks beyond the failed product incident to uncover whether or not the producing company is guilty of willful or negligent disregard for the consequences of their product(s) failure or alleged organizational negligence.
This breakthrough approach applies this methodology to the discovery stage of a case, resulting in the most efficient and equitable resolution for the client, plaintiff and defendant.
Forensic Business Pathology® originated from Tom Taormina's NASA experience during the Apollo 13 disaster. As part of the recovery team at Mission Control in Houston, Tom Taormina helped bring James Lovell, Fred Haise, and John Swigert back home that day on April 17, 1970 as the whole world watched in anticipation as Swigert uttered those famous words, “Houston, we’ve had a problem.”
From that moment until Apollo 13 splashed down, the operational procedures, processes and quality management tools developed became even more critical to mission success. It is from this basis that the principles of Forensic Business Pathology® were developed.
With a decade of case studies and favorable litigation outcomes, The Taormina Group has created a proven methodology that will introduce defendants’ and plaintiffs’ attorneys to a new set of tools that can quantify whether the appropriate standard of care was taken in the case.
Forensic Business Pathology® will change the way attorneys approach risk. This process can move the case focus from subjective evidence interpretation to concise narrative reports that establish degree of compliance with statutory, regulatory, industry and products standards by the defendant company.
